From Matthew Buchanan's "Promote the Progress" blog, a report on idea from Mark Lemley: Support improved patent quality by allowing applicants to pay for an enhanced examination to support a presumption of patent validity. Bears a resemblance to Lee Hollaar's "mini-patent" idea (pay a little to register your idea, pay more, much more, for rights to exclusivity) and to the systems in use in several other countries, where the default system is registration, and applicants must pay for examination.
I think this would be good, well worth trying.
