Texas is suing Sony under the state's anti-spyware law because of Sony's unhappy DRM that burrows into the root kit. Which Sony is already bending over backwards to try to remediate.
I can't help but wonder how much of a settlement Texas is hoping for. Will it go to consumers? What *are* the actual damages that this stuff has done anyway? And how many other prosecutions have there been under this law... against *real* makers of spyware as opposed to some other ware that happens to behave like it? What will liability for badly designed software look like in ten years? Or is this different because Sony blundered so badly here that it is not indicative of any general trend?
