I beg to differ. The simplifications are important, in terms of understanding the historical process, and because of Lessig's reliance on the tale as a model for current policy. The basic points are that the adaptive process occurred much earlier, and that it did not involve a wholesale overturn of prior doctrine but, instead, an effort at accommodation.
I must say, though, that I sort of like the idea of being the Howard Stern of IP. Can I get Sirius to pay me a fortune to run The Property Rights Show?
