Chicago law prof Douglas Lichtman has some comments on the Authors' Guild suit against Google.
He highlights one difficult point that is being neglected: We might be willing to allow Google to do this, what with its being an iconic company and all, but there is no legal principle that "Google is special." Whatever rule is crafted on the legitimacy of Google's action as fair use must be applicable to Joe Schmoe as well.
