The Centre for the New Europe has published Software is Patentable by Nature, a paper by Phillippe Simonnot if the Observatoire Economique du Droit of Université Versailles Saint-Quentin. In a nutshell:

By nature, software is patentable as a logical consequence of the economic theory of property. The Council was right to add a new provision to the existing legal framework.
